This Disclaimer governs the information published on motleyexim.com ("Site") by Motley Exim Co. ("MECo", "we", "us", "our"). By accessing the Site you accept the limitations and exclusions set out below. This Disclaimer is read together with our Terms of Service, Privacy Policy, Cookie Policy, and Export Compliance notice.
Defence-controlled products. Items described on this Site are controlled or potentially controlled under the Foreign Trade (Development & Regulation) Act, 1992 ("FTDR") and the SCOMET list (ITC(HS) Schedule 2 Appendix 3). Public descriptions are marketing summaries, not offers to sell. Supply, sample release, and export are conditional on end-user verification, sanctions screening, and applicable licences from the Directorate General of Foreign Trade ("DGFT") or other competent authorities.
1. Marketing Summaries vs. Contractual Specifications
The product descriptions, performance claims, photographs, datasheets, and technical references on this Site are marketing summaries intended to inform procurement enquiries. They are nominal indications of capability, drawn from in-house testing, customer feedback, and reference deployments.
Actual delivered specifications, tolerances, performance figures, environmental ratings, and acceptance criteria for any product are governed exclusively by the individual sales contract, purchase order, accepted Pre-Despatch Inspection ("PDI") report, and any product-specific Quality Assurance Plan agreed between MECo and the buyer in writing. Where a marketing summary on the Site differs from the agreed contract document, the contract document prevails.
This treatment is consistent with the caveat-emptor principle reflected in Section 16 of the Sale of Goods Act, 1930, in respect of merchantable quality and fitness for purpose in B2B sales of specified goods.
2. Accuracy and Completeness of Technical Data
We take reasonable care to ensure that the technical data on this Site is accurate as at the date stated on the relevant page. However:
- Defence textile, paint, and fire-suppression performance is sensitive to variables such as substrate, ambient conditions, deployment geometry, threat spectrum, and storage history. We do not guarantee identical performance under conditions other than those tested.
- Specifications may evolve as we improve products. The version of a product offered for a given enquiry is the version current at the time of quotation; older Site descriptions may not reflect the offered configuration.
- Test results referenced (radar attenuation in dB, thermal signature reduction, paint solar-reflectance, fire-suppression activation thresholds, etc.) are typical values from controlled lab or range tests, not guaranteed minima. Guaranteed minima, if any, are stated in the contract.
- Photographs and renders are illustrative. Engineered Camo Rocks, ghillie suits, and net assemblies are made-to-order and may differ in colour, weave, or texture from the images shown.
3. No Professional, Legal, or Operational Advice
Nothing on this Site is professional advice. The Site does not provide:
- Tactical or operational advice on the deployment of camouflage, concealment, or fire-suppression systems in any specific operational scenario. Operational deployment must be planned by the user's own qualified personnel under the user's own command structure.
- Legal advice on export controls, sanctions, end-use, or end-user obligations. Buyers must obtain their own legal counsel on Indian and home-jurisdiction export, import, and re-export laws.
- Engineering certification for fire safety, NBC protection, blast resistance, ballistic protection, or radar cross-section reduction in a buyer's particular application. Where such certification is required, it must be obtained from a competent independent body.
- Medical, occupational-safety, or environmental clearance. CARC paints and similar coatings carry handling restrictions; buyers and applicators must follow the relevant Material Safety Data Sheet ("MSDS") and applicable workplace and environmental regulations.
4. AS-IS Site Content
The Site is provided on an "AS-IS" and "AS-AVAILABLE" basis. To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions in relation to the Site and its content, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability.
We do not warrant that the Site will be uninterrupted, secure, or error-free; that defects will be corrected; that the Site or the server that makes it available is free of viruses or other harmful components; or that any links, downloads, or third-party resources referenced are safe or accurate.
5. Third-Party Content and Links
The Site may reference or link to third-party material — such as DGFT notifications, ISO-standard pages, cybercrime portals, or news coverage. We do not control these resources and are not responsible for their content, availability, or any change to them. A link is not an endorsement of the linked operator or the goods or services they describe.
6. Forward-Looking Statements
Statements on the Site about anticipated capabilities, planned product launches, R&D directions, multilingual rollouts, channel partnerships, or other future events are forward-looking. They depend on conditions outside our control — regulatory developments, supply-chain availability, foreign-policy events, and changes in customer requirements. 7. Use of the Site
The Site is intended for B2B defence procurement use by Indian and allied government, paramilitary, police, defence-PSU, OEM, and authorised commercial buyers. It is not directed at consumers, hobbyists, or persons under the age of 18. If you are not the intended audience, please do not rely on Site content for purchase decisions; commercial sale will not occur in any case without the screening and licensing steps set out in our Export Compliance and Terms of Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for any direct, indirect, incidental, special, consequential, or exemplary loss arising from your use of (or inability to use) the Site or any content on it, including without limitation loss of profit, loss of business, loss of data, or procurement of substitute goods. Where law prohibits the exclusion of certain liabilities, our liability is limited to the minimum permitted by that law. The complete contractual limitation of liability between MECo and any buyer is governed by the relevant sale contract and our Terms of Service.
9. Reservation of Rights
All rights not expressly granted on the Site are reserved. The trademarks CAMPRO®, MECO®, and FIRE ARMOR® are the property of MECo. Use of any trademark, logo, image, schematic, or copy is subject to our IP & Copyright Notice and Terms of Service. We may assert all available remedies — administrative takedown, civil action under the Trade Marks Act 1999 and the Copyright Act 1957, and criminal action where applicable — against unauthorised use.
10. Updates to this Disclaimer
We may update this Disclaimer from time to time to reflect changes in law, business practice, or Site content. Material updates take effect on the date stated at the top of this page. Continued use of the Site after that date constitutes acceptance of the updated Disclaimer. Earlier versions are not archived publicly; if you need an earlier version for compliance reasons, please write to us.
